1) Overview

This website is operated by Version43 (Sole Proprietorship). Throughout the site, the terms “we”, “us” and “our” refer to Version43. By accessing or using this website, placing an order, or interacting with us in any way, you agree to these Terms of Service (“Terms”).

2) Products, Pricing & Taxes

All prices are listed in INR and may change without prior notice.
Currently, we are not GST registered; our prices are final and inclusive of applicable charges.
We reserve the right to refuse service to anyone, at any time, for any reason, especially in cases of suspected abuse, fraud, or policy violations.

3) Orders & Acceptance

Orders placed on our website constitute an offer to purchase. We may accept, cancel, or limit any order at our discretion.
Reasons for cancellation may include stock unavailability, errors in product information or pricing, or suspected fraudulent/abusive transactions.
If an order is cancelled after payment, we will refund only the product value (shipping charges are non-refundable once dispatch has been initiated).

4) Payments

Payments are processed securely via Razorpay (UPI, Cards, Net Banking, Wallets, etc.).
By completing a payment, you confirm that the method used belongs to you and you authorize us and our payment processor to charge the order amount.
Chargebacks or payment disputes raised without contacting us first may result in blacklisting of the customer’s account.

5) Shipping & Delivery

Shipping timelines, charges, and policies are defined in our Shipping & Delivery Policy.
Risk of loss or damage transfers to the customer once the courier marks the order as “Delivered.”
Delivery attempts are limited; failure to accept or respond may result in the order being RTO (Returned to Origin). Reshipping charges will apply.

6) Cancellations, Returns & Refunds

Rules for cancellations, damaged/defective products, and refunds are covered in our Refund & Return Policy.
No return/refund requests will be entertained outside the defined timelines.
Products returned in used or tampered condition will not qualify for refunds or replacements.

7) Abuse & Misuse of Services

You agree NOT to:

Place fake, fraudulent, or bulk speculative orders.
Abuse COD options (if ever enabled in the future) by refusing parcels repeatedly.
Claim false damage/missing product without valid unboxing proof.
Misuse promo codes, referral credits, or exploit website errors.
Harass, threaten, or abuse our support team on email/WhatsApp/social media.

We reserve the right to suspend, block, or blacklist accounts found violating these terms, without prior notice.

8) Intellectual Property

All designs, product photos, graphics, and branding (“V.43,” “Version43,” “Body of Designs”) are our property. You may not copy, distribute, or use them without permission.

9) Limitation of Liability

Our maximum liability in any case shall not exceed the actual amount paid by you for the product in question.
We are not responsible for indirect or consequential losses, including courier delays, website downtime, lost profits, emotional distress, or third-party actions.
Once an order is delivered and confirmed by the courier, we are not liable for theft, loss, or damage thereafter.

10) Indemnification

You agree to indemnify and hold harmless Version43 and its team from any claims, damages, losses, or expenses arising from your misuse of our site, violation of these Terms, or infringement of any rights.

11) Force Majeure

We are not responsible for delays or failures due to events outside our control—courier strikes, natural disasters, internet outages, government restrictions, pandemics, etc.

12) Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes will be subject exclusively to the courts of Bengaluru, Karnataka.
If required by law, we may also resolve disputes via arbitration before a neutral arbitrator in Bengaluru.

13) Changes to Terms

We may update these Terms anytime. The updated Terms will be effective immediately upon posting, with the “Last updated” date shown above. Continued use of our website means acceptance of any changes.
